SPC Releases Guiding Opinions on Proper Trial of COVID-19-related Civil Cases According to the Law

the Opinions are intended to: 1. stress the resolution of disputes in different ways; 2. clarify and detail the rules for the application of law relating to force majeure; 3. focusing on safeguarding rights and interests of laborers and consumers; and 4. legally protect interests related to limitation of action and the right to litigation. Among others, the Opinions state that where employers claims to terminate the labor relations on the ground that the laborers are confirmed or suspected COVID-19 patients or asymptomatic carriers of COVID-19, are quarantined as legally required, or come from the regions seriously hit by the epidemic, the people's courts shall not uphold such claims. Additionally, the Opinions clarify that where consumers claim punitive damages in accordance with the relevant legal provisions, the people's courts shall uphold these claims.
